Mississippi Execution Stayed

The United States Supreme Court has stayed the execution of Mississippi murderer Bobby Glen Wilcher for the 1982 murder of Katie Belle Moore and Velma Odell Noblin. The order is on the second page of yesterday's "Miscellaneous Orders" here. "The Chief Justice, Justice Scalia, and Justice Alito would deny the application for stay of execution." The Associated Press story is here. Wilcher was apparently a so-called "volunteer" who may or may not have changed his mind at the last minute. The Fifth Circuit opinion on Monday is here. Update, July 14: The Supreme Court docket indicates that the certiorari petition is scheduled for the conference of Monday, Sept. 25. If the Court follows last year's practice, we can expect an orders list on Tuesday with a grant or denial of certiorari.
