Today at 2:30 ET, the U.S. Senate Judiciary Committee will consider a nomination for the purpose of moving the Court of Appeals for the Ninth Circuit even further out of the judicial mainstream than it already is. As noted in my prior
post, in 2005 nominee Goodwin Liu wrote a paper attacking then Justice-nominee Samuel Alito's record in death penalty cases. The paper reveals that Liu's views on the death penalty and on habeas corpus are fully aligned with the current hard left wing of the Ninth Circuit.

Update: David Ingram at BLT
reports that the hearing has been postponed. "Rule 26 of the Senate prohibits committees from meeting after 2 p.m. without the consent of the leaders of both major parties. The rule is routinely waived to allow afternoon hearings, but Republicans objected Tuesday and today, as the Senate debates revisions to the just-enacted health-care overhaul."
Update 2: Ed Whelan at Bench Memos has
this comment on the postponement.
