A Real Winner

Six murders, four rapes, two death sentences from two different states - and Alfred Prieto is still breathing.  Here is a case that poignantly demonstrates the deficiencies with the California death penalty track.

To best explain Prieto's homicidal history, a timeline might be best.
May 1988:  Prieto raped and shot to death Tina Jefferson in Arlington, Virginia. 

December 1988:  Prieto shot to death Rachael Raver and Warren Fulton III, both 22-years-old, in Reston, Virginia.  He left their bodies dumped in a vacant lot.

February - September (?) 1990:  Some time after moving to California, Prieto shot to death two people in Riverside County.  Officials have not released information about the victims.

1990:  Prieto and two other men raped three women in the town of Ontario, California.  The other men stabbed their victims (who lived), but Prieto shot to death 15-year-old Yvette Woodruff.

Prieto was convicted and sentenced to death in California for the 1990 murder of Woodruff.  After his appeals remained stagnant for 18 years, however, Virginia extradited him in 2008 in the hopes of convicting and executing him for the 1990 murders of Raver and Fulton.  He was sentenced to death by a Virginia jury, but the Virginia Supreme Court reversed the sentence based on an improper verdict form.  Jury selection for the resentencing began earlier this month.   

On Monday, it was revealed that DNA evidence linked Prieto to the two unsolved 1990 murders in Riverside.  Despite a request from Riverside County that Virginia strike a deal with Prieto in exchange for his cooperation in California, Virginia prosecutors are still seeking a death sentence.

This case is yet another illustration of the immorality of Woodson v. North Carolina. The death penalty here should be mandatory.
