We now have a split of authority on the constitutionality of the Stolen Valor Act, 18 U.S.C. ยง704(b), making it a crime to falsely claim an award of a military medal. As noted in previous posts here and here, the act had been held unconstitutional by a District Court in Colorado and by the Ninth Circuit.

If this decision goes up to the Fourth Circuit and is affirmed, we will then have a "circuit split" worthy of the Supreme Court's attention.
