Don Heller wrote the current 1978 statute. His statement that life imprisonment is a "promise" that murderers will never be released is wrong. The best proof is in the 1978 statute that Heller wrote. That statute includes an instruction that specifically instructs the jury that life sentences can be reduced by the Governor. Heller's own statute proves that the state cannot promise that a life prisoner can never be released. Perhaps he has forgotten...
