The NY Times Take on Moore v. Texas:   "Texas cannot satisfactorily explain why it applies current medical standards for diagnosing intellectual disability in other contexts, yet clings to superseded standards when an individual's life is at stake," wrote Justice Ruth Bader Ginsberg in her 5-3 opinion in Moore v. Texas, which overturned a murderer's death sentence.  Adam Liptak of the Times reports that the decision was the most recent in a series of rulings refining (read expanding) Atkins v. Virginia which announced that it is unconstitutional to execute mentally retarded murderers.  Moore fatally shot a 72-year-old store clerk in the head with a shotgun during a robbery in 1980.  He wore a wig during the robbery, then hid the shotgun and fled to Louisiana to avoid arrest.  Justice Ginsburg held that the Texas Court of Criminal Appeals had given too much weight to Moore's adaptive skills and knowledge of guilt, and not enough to his low IQ scores.  The story in the Houston Chronicle provides a more balanced perspective.

Arrest Made in Fla. Cop Shootings:  Miami-Dade police have arrested a 19-year-old man they believe ambushed two Florida homicide detectives Monday.  David Ovalle & Charles Rabin of the Miami Herald report that both detectives were in a unmarked van at a housing project doing surveillance on a suspect vehicle when a group of men approached.  One of the men opened fire with a semiautomatic rifle striking the vehicle at least eight times and wounding both officers.  One of the detectives recognized the shooter as Damian "Damo" Thompson, who is a suspected associate with a street gang.  Thompson, who was arrested last November for drug dealing, and in January on an illegal weapons charge, now faces trial on two counts of attempted murder.
