FDA Thiopental Suit Set for Argument

The murderers' suit against the FDA for allowing importation of the sodium thiopental used in lethal injections has been set for oral argument in the D.C. Circuit March 25.  The panel is Judges David Sentelle, Judith Rogers, and Douglas Ginsburg.

The case was captioned Beaty v. FDA in the District Court.  It is presently captioned Cook v. FDA.  It may have a different caption by the time it is decided.  Arizona keeps "mooting" the lead plaintiffs.

The plaintiffs are represented by the Arizona Federal Public Defender, despite the absence of any statutory authorization for that office to file civil suits, and by the law firm of Sidley Austin LLP, contra bono publico.
