US Supreme Court conference day is an unusual Tuesday in this short work week. The Court issued this short orders list of routine stuff.
The only criminal case on the list is Williams v. Illinois, looking yet again at the Confrontation Clause and laboratories. The Court granted the motion of the US Solicitor General to argue as amicus, as it almost always does.
In a more unusual order, the Court granted divided argument to nongovernment respondents in FCC v. Fox, a case dealing with fleeting expletives, wardrobe malfunctions, etc.
Presumably we will find out Monday what cases they took up today. SCOTUSblog's "Petitions to Watch" list is here. The full conference list, with capital cases flagged, is at the Cert Pool.
